The terms governing use of this website and the general terms for our design, supply and setup services.
Last updated: September 19, 2026
These Terms of Service ("Terms") govern your access to kitchenandhomestuff.site and describe the general terms under which Kitchen and Home Stuff Inc. provides design, product supply, setup, installation and organizing services. By using this website you agree to these Terms.
1. About Us
Kitchen and Home Stuff Inc. is a home design and setup company located at 3464 Junction Street, North Port, FL 34288, serving Southwest Florida.
2. Website Use
- Use this site for lawful purposes only.
- Do not attempt to disrupt, damage or gain unauthorized access to the site.
- Do not scrape, copy or republish site content or project photographs without written permission.
- Do not submit false information or use our forms for unsolicited commercial messages.
3. Information Is Not An Offer
Prices, ranges, timelines and service descriptions on this website, including those on the homepage and pricing page, are general information for planning. They are not quotes or offers. Final pricing is set in a written quote after we have seen the space.
4. Consultations And Quotes
- The initial on site consultation within our service area is free and carries no obligation.
- Written quotes state scope, service fees, timeline and any allowances, and are valid for the period stated.
- Design plans produced for a fee remain chargeable whether or not you proceed to a full package.
- Quotes are based on the conditions observed. Conditions discovered later that materially change the work require a written change order.
5. Products Purchased At Cost
- Products are billed at our actual cost with no markup, and receipts are provided.
- Where we purchase on your behalf, a product deposit is required in advance and the final amount is reconciled against receipts.
- Product prices, availability and lead times are set by retailers and manufacturers and can change without notice.
- We are not the manufacturer or seller of the products. Warranties, recalls and defects are handled through the manufacturer or retailer, and we assist with those claims.
- Discontinued or out of stock items may require substitution, which we will present for your approval.
6. Scheduling, Access And Site Conditions
- You are responsible for providing access to the home on scheduled days, including codes, keys or a person present.
- Failed visits caused by no access may incur a trip charge.
- Areas should be reasonably clear so crews can work safely.
- We require a staging area for deliveries, such as a garage or spare room.
- Pets should be secured during work for their safety and ours.
- Please tell us in advance about fragile, valuable or sentimental items in the space.
7. Scope Of Installation Work
Our setup work covers assembly, mounting, anchoring, placement, organizing, styling and the basic connection of plug in appliances. It does not include work requiring a licensed trade, including electrical rewiring, gas connections, plumbing alterations, structural changes or permitted construction. Where such work is needed we will identify it and can coordinate licensed contractors, who contract with you directly unless otherwise agreed.
8. Wall Mounting And Anchoring
We mount and anchor according to product instructions and standard practice for the wall type found. We cannot guarantee the condition of unseen wall structure, prior repairs, or substrates we are not able to inspect. Where a wall is unsuitable for a proposed mounting we will tell you and propose an alternative rather than proceed.
9. Payment
- A service deposit, typically 50 percent, is required to schedule work.
- The balance of service fees is due on completion unless a milestone schedule is agreed.
- Product deposits are separate and cover actual purchases.
- Past due balances may accrue interest and collection costs as permitted by Florida law.
10. Cancellation
Service deposits are refundable up to 7 days before a scheduled setup date, less the value of any design work already performed. Cancellations inside 7 days may forfeit the deposit due to reserved crew time. Products already ordered are subject to the retailer's return policy, and we will handle eligible returns on your behalf. Custom and made to order products are generally non returnable.
11. Returns And Deliveries
Return, delivery and damage procedures are set out in our Shipping and Returns policy, which forms part of these Terms.
12. Warranty
Our workmanship warranty and product care guidance are set out on our Warranty and Care page.
13. Portfolio Use
We may photograph completed projects for our portfolio, website and social media. Names and addresses are not published without permission, and you may opt out in writing.
14. Limitation Of Liability
To the maximum extent permitted by Florida law, our total liability for any claim is limited to the amount you paid us in service fees for the project giving rise to the claim. We are not liable for indirect, incidental, special or consequential damages, for defects in products manufactured by others, or for delays caused by retailers, carriers or manufacturers.
15. Force Majeure
Neither party is liable for failure to perform due to events beyond reasonable control, including hurricanes, severe weather, flooding, supply shortages, carrier delays, illness or government action.
16. Governing Law
These Terms are governed by the laws of the State of Florida without regard to conflict of law principles. Disputes shall be brought in the state or federal courts located in Sarasota County, Florida, unless your written agreement provides otherwise.
17. Changes And Contact
We may revise these Terms at any time. Changes take effect when posted with an updated date. Where a signed agreement conflicts with these Terms, that agreement controls for the project it covers.
